TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of the YESIDO South Africa website and all orders placed through the website.

The website is operated by Oxfame Trading CC (“YESIDO South Africa”).

By accessing or using the website, creating an account, submitting an order or purchasing products through the website, the customer agrees to be bound by these Terms, subject to applicable South African law.

These Terms must be read together with the Returns, Refunds & Cancellation Policy, Shipping Policy and Privacy Policy.

Nothing in these Terms excludes, restricts or limits any statutory right or remedy that cannot lawfully be excluded or limited.


1. USE OF THE WEBSITE

1.1

The website may only be used for lawful purposes.

1.2

Users may not:

  • Use the website for fraudulent, unlawful or abusive purposes;
  • Submit false, misleading or fraudulent information;
  • Attempt unauthorized access to the website, accounts, servers or systems;
  • Introduce viruses, malware or harmful code;
  • Interfere with the security or operation of the website;
  • Scrape, reproduce or commercially exploit website content without authorization;
  • Impersonate another person or business;
  • Use unauthorized payment information; or
  • Use the website in any manner that infringes the rights of YESIDO South Africa or any third party.

1.3

YESIDO South Africa may suspend, restrict or terminate access where there are reasonable grounds to suspect fraud, unlawful activity, abuse or a material breach of these Terms.


2. CUSTOMER RESPONSIBILITY

2.1

Customers are responsible for providing complete and accurate information, including their:

  • Name;
  • Contact details;
  • Email address;
  • Billing information; and
  • Delivery address.

2.2

Customers must carefully review their order before submitting it.

2.3

Customers are responsible for selecting the correct product, model, specification, colour, variation, quantity and compatibility.

2.4

Where YESIDO South Africa has reasonably provided compatibility or specification information, the customer remains responsible for ensuring that the selected product meets their requirements before purchasing.

2.5

To the extent permitted by law, YESIDO South Africa will not be responsible for additional costs or delays resulting from incorrect or incomplete information supplied by the customer.


3. PRODUCTS & PRODUCT INFORMATION

3.1

YESIDO South Africa takes reasonable steps to provide accurate product descriptions, specifications, photographs and information.

3.2

Product images are primarily for identification and illustrative purposes.

Minor differences in colour, packaging, labelling, presentation or appearance may occur due to manufacturing changes, display settings, photography or updated packaging, provided that such differences do not materially alter the nature or functionality of the product.

3.3

Customers must review all available product information before purchasing.

3.4

YESIDO South Africa does not guarantee compatibility with a particular device or application unless compatibility is expressly stated in the relevant product description.

3.5

Nothing in this section limits statutory rights where goods supplied materially fail to correspond with their description or applicable legal requirements.


4. PRICES

4.1

All prices are displayed in South African Rand (ZAR) unless otherwise stated.

4.2

Applicable taxes and charges will be included or disclosed as required by law.

4.3

YESIDO South Africa may change prices at any time before an order is concluded.

4.4

Promotional prices apply only for the stated promotional period and may be subject to available stock.


5. OBVIOUS PRICING, LISTING & TECHNICAL ERRORS

5.1

YESIDO South Africa takes reasonable measures to maintain accurate pricing and product information. However, genuine human, system, technical or listing errors may occur.

5.2

Where a product has been displayed with an obviously incorrect price, discount, description, specification or quantity as a result of a genuine error, YESIDO South Africa reserves the right to correct the error and take such action regarding an affected order as is permitted by applicable law.

5.3

Where permitted by law, an affected order may be cancelled and any amount already paid for the cancelled product will be refunded.

5.4

YESIDO South Africa will not knowingly rely on this provision to avoid a valid transaction merely because a price subsequently becomes commercially unfavorable.


6. STOCK AVAILABILITY

6.1

All products are subject to stock availability.

6.2

Adding a product to a shopping cart does not reserve stock.

6.3

Stock discrepancies may occur because of simultaneous purchases, inventory discrepancies, damaged stock, technical errors or other operational circumstances.

6.4

Where an ordered product is unavailable, YESIDO South Africa may, subject to applicable law:

  • Cancel the unavailable item and refund the applicable amount;
  • Offer the customer an alternative product; or
  • Offer another lawful solution.

6.5

A materially different substitute will not be supplied without the customer's agreement where such agreement is legally required.


7. ORDERS & ACCEPTANCE

7.1

Submitting an order constitutes an offer by the customer to purchase the selected products subject to these Terms.

7.2

An automated email, payment notification or order acknowledgement confirms receipt of the order but does not necessarily constitute final acceptance where stock, payment, fraud or other reasonable verification remains outstanding.

7.3

YESIDO South Africa may refuse, hold or cancel an order where reasonably justified and legally permitted, including where:

  • Payment fails or cannot be verified;
  • Stock is unavailable;
  • A genuine pricing or listing error occurred;
  • Fraud or unauthorized payment is reasonably suspected;
  • Materially incorrect customer information was supplied;
  • The order appears intended for unlawful activity;
  • Website or payment-system abuse is suspected; or
  • Fulfilment is prevented by circumstances beyond YESIDO South Africa's reasonable control.

7.4

Where YESIDO South Africa lawfully cancels an order for which payment has already been received, the amount legally due to the customer will be refunded.


8. PAYMENT

8.1

Payment must be made through a payment method offered on the website.

8.2

YESIDO South Africa is not required to dispatch an order until payment has been successfully received or authorized, as applicable.

8.3

Orders may be held while reasonable payment or fraud verification is conducted.

8.4

Customers warrant that they are authorized to use the payment method submitted.

8.5

Third-party payment providers may process payments and may be subject to their own lawful terms and security procedures.


9. CANCELLATION BY THE CUSTOMER

9.1

Customers wishing to cancel an order before dispatch should contact YESIDO South Africa immediately.

9.2

YESIDO South Africa will attempt to stop an order that has not yet been processed or dispatched but does not guarantee that cancellation can be completed once fulfilment has commenced.

9.3

Once an order has been dispatched, cancellation or return will be governed by the Returns, Refunds & Cancellation Policy and applicable law.

9.4

Nothing in this section limits a statutory cancellation or cooling-off right where such right legally applies.


10. NO VOLUNTARY CHANGE-OF-MIND RETURNS

10.1

YESIDO South Africa does not voluntarily accept returns, exchanges or refunds solely because a customer has changed their mind.

10.2

This includes circumstances where the customer:

  • No longer wants the product;
  • Ordered the incorrect product;
  • Selected the incorrect model, colour, specification or variation;
  • Purchased an incompatible product where relevant compatibility information was reasonably provided;
  • Found the product cheaper elsewhere; or
  • No longer requires the product.

10.3

This provision does not affect a statutory cancellation or return right that applies under South African law.


11. DELIVERY

11.1

Products will be delivered to the address supplied by the customer.

11.2

The customer is responsible for ensuring that the delivery address is complete and accurate and that the premises can reasonably be accessed by the courier.

11.3

Delivery estimates are estimates unless expressly guaranteed or otherwise required by law.

11.4

YESIDO South Africa is not responsible, to the extent permitted by law, for delays resulting from circumstances beyond its reasonable control.

11.5

Where delivery fails because:

  • The customer supplied an incorrect or incomplete address;
  • Nobody is reasonably available to receive the parcel;
  • Access to the premises cannot be obtained; or
  • Another circumstance attributable to the customer prevents delivery,

YESIDO South Africa may recover reasonable additional courier or redelivery costs where legally permitted.


12. DELIVERY DAMAGE — 24-HOUR REPORTING REQUEST

12.1

Customers are requested to inspect the product itself immediately upon receipt or as soon as reasonably possible thereafter.

12.2

Visible physical damage to the product believed to have occurred during transportation should be reported within twenty-four (24) hours after the customer receives the order.

12.3

Customers should provide photographs and information reasonably required to verify the claim.

12.4

Damage to the outer courier packaging, shipping carton or product packaging alone will not constitute product damage where the actual product is undamaged and otherwise conforms to the order.

12.5

A visibly damaged product should not be used, installed, modified or continued to be used beyond what is reasonably necessary to inspect it.

12.6

The 24-hour reporting period assists YESIDO South Africa in establishing whether physical damage occurred during transportation and does not remove statutory rights that cannot lawfully be excluded.


13. RETURNS, DEFECTS & REFUNDS

13.1

Returns, defective-product claims, delivery-damage claims, refunds, incorrect products and warranty claims are governed by the Returns, Refunds & Cancellation Policy.

13.2

YESIDO South Africa may reasonably inspect and test a returned product before determining whether the reported defect or damage exists and its cause.

13.3

Where inspection establishes that no defect exists, or that damage was caused by misuse, accidental damage or another matter for which YESIDO South Africa is not legally responsible, reasonable costs may be recovered from the customer where permitted by law.

13.4

Nothing in these Terms limits statutory remedies available for qualifying defective, unsafe or non-conforming goods.


14. MISUSE & CUSTOMER-CAUSED DAMAGE

Subject to applicable law, YESIDO South Africa will not ordinarily be responsible for faults or damage caused by:

  • Misuse or abuse;
  • Accidental or physical damage after delivery;
  • Liquid or moisture exposure;
  • Negligence;
  • Incorrect installation;
  • Improper storage;
  • Unauthorized repair or modification;
  • Incompatible equipment or accessories;
  • Power surges or unsuitable electrical supply;
  • Failure to follow operating, charging or safety instructions;
  • Normal wear and tear; or
  • Acts or omissions of the customer or third parties.

15. WHOLESALE, RESELLER & B2B TRANSACTIONS

15.1

Wholesale, reseller, bulk and business transactions may be subject to additional quotations, invoices, credit terms or written commercial agreements.

15.2

To the extent permitted by applicable law, separate commercial terms agreed for a wholesale or business transaction will prevail over these general Terms where there is a conflict.

15.3

Unless agreed otherwise in writing or required by law, YESIDO South Africa does not accept wholesale/reseller returns merely because:

  • Excess stock was ordered;
  • The purchaser ordered the incorrect item or quantity;
  • Stock is slow-moving;
  • The purchaser cannot resell the stock;
  • Market demand changes;
  • The purchaser's own customer cancels or changes their mind; or
  • The purchaser's commercial requirements change.

15.4

Wholesale customers are responsible for verifying product codes, quantities, specifications and prices before confirming an order.

15.5

Nothing in this section excludes rights that legally apply to a particular transaction.


16. PROMOTIONS & DISCOUNT CODES

16.1

Promotions, coupons and discount codes may be subject to additional promotional conditions.

16.2

Unless expressly stated otherwise:

  • Promotions cannot be exchanged for cash;
  • Discounts cannot be retrospectively applied;
  • Discount codes may not be combined;
  • A code may be limited to one use per customer or order;
  • Promotions may exclude particular products;
  • Promotions remain subject to stock availability; and
  • Promotions expire at the stated time.

16.3

YESIDO South Africa may reject or cancel the unauthorized, fraudulent or abusive use of a promotional offer where permitted by law.


17. ACCOUNTS

17.1

Customers are responsible for maintaining the confidentiality of account login details.

17.2

Activity performed through an account may be subject to reasonable verification where unauthorized access is suspected.

17.3

YESIDO South Africa may suspend accounts reasonably suspected of fraud, abuse, security compromise or unlawful activity.


18. INTELLECTUAL PROPERTY

18.1

Website content, including product photographs, graphics, layouts, text, designs and other original material, may not be copied, reproduced, republished, distributed or commercially exploited without authorization except where permitted by law.

18.2

YESIDO trademarks, logos and other proprietary brand material remain the property of their respective lawful owners.

18.3

No use of the website grants the user ownership of any intellectual property appearing on it.


19. REVIEWS & USER-SUBMITTED CONTENT

Customers must not submit content that is unlawful, fraudulent, knowingly false, defamatory, threatening, abusive, malicious, infringing, spam or unrelated commercial advertising.

YESIDO South Africa may moderate or remove content where reasonably justified and permitted by law.


20. THIRD-PARTY SERVICES

The website may use third-party payment processors, couriers, applications, platforms and other service providers.

YESIDO South Africa does not control independent third-party services and, to the extent permitted by law, is not responsible for their independent acts, omissions, systems or content.

Nothing in this section excludes responsibility that South African law specifically places on YESIDO South Africa.


21. FRAUD, ABUSE & VERIFICATION

YESIDO South Africa may reasonably investigate suspected:

  • Payment fraud;
  • Unauthorized transactions;
  • False identities or information;
  • Fraudulent returns;
  • Product substitution;
  • Serial-number mismatches;
  • Tampering;
  • False defect claims;
  • Promotional abuse; or
  • Other unlawful conduct.

Where reasonably justified and legally permitted, an affected transaction, order or account may be held, refused, restricted or cancelled.

YESIDO South Africa may cooperate with payment providers, financial institutions, courier companies and lawful authorities where legally permitted or required.


22. LIMITATION OF LIABILITY

22.1

To the maximum extent permitted by applicable South African law, YESIDO South Africa will not be liable for indirect, incidental, special or consequential loss arising from use of the website, inability to access the website, or circumstances for which YESIDO South Africa is not legally responsible.

22.2

YESIDO South Africa will not be responsible, to the extent permitted by law, for loss or damage caused by customer misuse, unauthorized modification, incorrect installation, incompatible equipment, failure to follow instructions or other conduct outside YESIDO South Africa's reasonable control.

22.3

The website may temporarily be unavailable because of maintenance, technical failure, third-party systems, internet disruption or other circumstances.

22.4

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, nor does it remove any mandatory consumer remedy.


23. INDEMNITY FOR UNLAWFUL USE

To the extent permitted by law, a user will be responsible for losses, claims or reasonable costs suffered by YESIDO South Africa arising directly from that user's unlawful, fraudulent or unauthorized use of the website or material breach of these Terms.

This provision does not require a consumer to indemnify YESIDO South Africa for matters for which YESIDO South Africa is legally responsible.


24. PRIVACY

Personal information is processed in accordance with the Privacy Policy and applicable South African law.

Customers should review the Privacy Policy before providing personal information through the website.


25. ELECTRONIC COMMUNICATIONS

Customers acknowledge that transactional communications may be provided electronically, including:

  • Order confirmations;
  • Invoices;
  • Payment notifications;
  • Delivery updates;
  • Cancellation notices;
  • Return communications; and
  • Other information relating to an order.

Marketing communications will be managed in accordance with applicable law and communication preferences.


26. EVENTS BEYOND REASONABLE CONTROL

To the extent permitted by law, YESIDO South Africa will not be responsible for delays or failures resulting from circumstances beyond its reasonable control, including severe weather, natural disasters, fire, strikes, civil disturbances, infrastructure failures, telecommunications failures, transportation disruptions, courier network disruptions, governmental restrictions or similar events.

Any statutory rights that continue to apply despite such circumstances remain unaffected.


27. CHANGES TO THESE TERMS

YESIDO South Africa may amend these Terms from time to time to reflect changes in operations, technology, products or applicable law.

The version published on the website at the relevant time will apply subject to applicable law.

Changes will not retrospectively remove statutory rights already accrued.


28. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed, limited or interpreted to the extent necessary to make it lawful where possible.

The remaining provisions will continue to apply.


29. NO WAIVER

A failure or delay by YESIDO South Africa to enforce any lawful provision of these Terms does not constitute a permanent waiver of that provision or YESIDO South Africa's right to enforce it subsequently.


30. ENTIRE AGREEMENT

These Terms, together with the applicable order information, Returns, Refunds & Cancellation Policy, Shipping Policy, Privacy Policy and any additional written terms expressly applicable to a transaction, constitute the terms governing the relevant website transaction, subject to applicable law.


31. GOVERNING LAW

These Terms and transactions conducted through the website are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and any statutory dispute-resolution rights available to the parties.
